Matrimonial Real Property (MRP) On Reserve

The Congress of Aboriginal Peoples (CAP) has been invited by the Minister of Indian Affairs and Northern Development, the Honourable Jim Prentice, to participate in a national dialogue to resolve the Indian Act’s failure to deal with disputes over Matrimonial Real Property on reserve lands (MRP).

The Congress of Aboriginal Peoples (CAP) has prepared a Matrimonial Real Property on reserve Discussion Guide, along with a Survey and Glossary to assist you in participating in this important dialogue. These documents are available in PDF Format which you will find on the bottom of this page. The Survey can be downloaded and printed, fill it in and fax it to: MRP Coordinator at 613-747-8834. Why Is This Issue So Important?

Three Common Scenarios

 

Case # 1: The Present – For Non-Status, Non-Member Indians

Marital Status:

Ron is a status Indian and a member of a Treaty 8 Band and holds a certificate of possession for the land on which the marital home is built.  Mary is also a Treaty 8 Indian and her mother is from the same community, but she is not a status Indian or a member of the band.

 

 

Case # 2: The Present – For Status non-Member Indians

Marital Situation

George and Anne are both status Indians, but Anne is not a member of the band on which their home is built and where they live with their children.  The land allotment on which the house was built is held under a Certificate of Possession, under George’s name only.

 

 

Case # 3: Band Member with No CP or Custom Allotment

Marital Situation

Both spouses are members of the band in this Treaty # 8 reserve community, but only Fred is named in the Certificate of Possession or Custom Allotment documents, while Irene is not.
